Terms and Conditions

1. ACCEPTANCE OF TERMS

• By booking services with Capture & Share Photo Booth, you agree to these Terms and Conditions. 
• We cannot confirm your reservation until you accept this agreement.

2. SERVICES OFFERED

• Capture & Share Photo Booth provides professional photo booth services for private and corporate events.
• Our services include, but are not limited to, the Open-Air Mirror Photo Booth, 360 Video Xperience, Roaming Photo Booth, and Keychain Station.

3. BOOKING AND PAYMENTS

• Book all services in advance, subject to availability.
• Your client contract outlines payment instructions and due dates.

4. EVENT SETUP & OPERATION

• Capture & Share Photo Booth will deliver, set up, operate, and remove the products included in your package.
• We work hard to provide every guest with a smooth and enjoyable experience.
• If printer issues occur, we will make every reasonable effort to repair or replace the equipment. If we cannot restore printing during the event, we will provide digital copies of all available images whenever possible.

5. LIMITATION OF LIABILITY

• Capture & Share Photo Booth is not responsible for damages or losses resulting from circumstances beyond the following:

1. Severe Weather
2. Unexpected Equipment Malfunctions
3. Third-Party Vendor Issues.

• Our maximum liability under this agreement will never exceed the total amount you paid for the contracted services.

6. INTELLECTUAL PROPERTY

• Capture & Share Photo Booth retains ownership of all photos, videos, templates, graphics, and other content created during the event unless we agree otherwise in writing.
• Unless you request otherwise in writing, we may use photos and videos from your event for marketing, advertising, social media, our website, and other promotional materials.

7. GOVERNING LAW

• The laws of the State of New York govern these Terms and Conditions.

8. CHANGES TO TERMS

• Capture & Share Photo Booth reserves the right to update or modify these Terms and Conditions at any time.

9. DEPOSITS & CANCELLATIONS

• Deposit – A non-refundable $100 deposit reserves your event date and applies toward your final balance.
• Client Cancellations – The non-refundable deposit covers reservation time, declined bookings, and event preparation.
• Company Cancellations – If Capture & Share Photo Booth cancels your event, we will refund all payments you made.

10. UNFORESEEN CIRCUMSTANCES

• Neither party will be responsible for delays or failure to perform because of acts of God, extreme weather, government actions, pandemics, or other events beyond reasonable control.
• Instead of issuing a refund, we will apply all payments as a credit toward a future booking. You may use that credit within 12 months of the original event date.

11. PHOTO BOOTH USE

• The Client is responsible for ensuring that all guests use the photo booth safely and appropriately.
• The Client accepts responsibility for any damage caused by guests and agrees to pay all repair or replacement costs.

12. 360 VIDEO XPERIENCE

• Guests participate at their own risk.
• Guests may not jump, push, horseplay, or engage in unsafe behavior.
• Guests must follow the operator’s instructions at all times.
• Capture & Share Photo Booth reserves the right to refuse service to anyone whose behavior creates an unsafe environment.

13. KEYCHAIN STATION

• We produce keychains only during contracted event hours.
• Additional keychains beyond your package may incur additional charges.
• Guests may experience wait times during busy periods.

14. WI-FI REQUIREMENTS

• Our Mirror Photo Booth, 360 Video Xperience, and Roaming Photo Booth require a reliable venue Wi-Fi connection to deliver photos instantly through SMS, QR code, and email.
• If the venue cannot provide a reliable connection, instant delivery will not be available during the event. We will deliver all available photos digitally after the event.
• We are not responsible for interruptions caused by unreliable or unavailable internet service.

15. VENUE RESTRICTIONS

Capture & Share Photo Booth is not responsible if:

• The venue delays our setup.

• The venue experiences a power outage.

• The venue requires us to end services before the contracted end time.
